福建省福州市中级人民法院一审认为，宁化县农业农村局的处罚决定及相关复议决定合法，认定事实清楚，证据充分，程序合法，应予维持，判决驳回科某公司的诉讼请求。科某公司不服，提起上诉。最高人民法院二审认为，侵权行为是否损害社会公共利益的认定，需统筹考量侵权制种规模、对种业生产经营秩序的破坏程度以及对国家农业用种安全的潜在影响等因素。本案科某公司未经品种权人许可，委托他人使用“R900”品种作为父本生产杂交水稻种子，侵害“R900”植物新品种权，该事实有两次鉴定意见及科某公司在和解协议中的自认作为依据，科某公司制种规模较大，其行为侵害种业市场秩序等社会公共利益，符合种子法规定的行政处罚条件。行政责任与民事责任分属不同法律责任范畴，虽然科某公司与袁某公司已达成和解，但民事责任的承担并不能当然成为免除或替代行政责任的理由。宁化县农业农村局综合其违法情节及从轻情形以法定的罚款计算标准下限作出5倍罚款，符合过罚相当原则，故判决驳回上诉、维持原判。
